Terms of Service

Please read these Terms of Service ("Terms") carefully before using the ElyIT website at elyit.com ("Site") or enrolling in any ElyIT programs. By accessing the Site or purchasing a course, you agree to be bound by these Terms. If you do not agree, please do not use our Site or services.

1. About ElyIT

ElyIT is an Arizona-based provider of IT certification exam preparation materials and instructional support services. We help adult learners and high school students build practical technology skills and prepare for industry-recognized certifications from organizations including CompTIA and Cisco. ElyIT is based in Surprise, Arizona and delivers services both locally and virtually.

2. Regulatory Status & Nature of Services

ElyIT is not licensed by the Arizona State Board for Private Postsecondary Education (AZ PPSE) under Arizona Revised Statutes § 32-3001 et seq. ElyIT does not operate as a licensed private postsecondary educational institution and does not offer degrees, diplomas, college credit, or credentials recognized as postsecondary academic credentials under Arizona or federal law.

The services and materials provided by ElyIT consist of exam preparation content, instructional support, skills-building activities, and career readiness resources intended to assist learners in independently studying for and pursuing third-party IT certification examinations. These services are classified as exam preparation and instructional support services, not licensed postsecondary education.

ElyIT participates in the Arizona Empowerment Scholarship Account (ESA) program administered by the Arizona Department of Education. Under this program, ElyIT may provide individualized and small-group instructional support services to eligible Arizona K–12 students, including high school-aged students, delivered virtually and through in-person events. ESA services are separate from and not subject to AZ PPSE licensing requirements. Participation in the ESA program is governed by the applicable ESA program agreement between the family and the Arizona Department of Education.

3. Eligibility

Adult learners: You must be at least 18 years of age to independently create an account, enroll in a course, or make a purchase on this Site. By using our services directly, you represent that you are 18 years of age or older.

Minor students (ESA program): High school students under the age of 18 may participate in ElyIT programs through the Arizona ESA program when enrolled by a parent or legal guardian. By enrolling a minor in any ElyIT program, the parent or guardian represents that they have authority to agree to these Terms on the minor's behalf and that the enrollment is authorized under the applicable ESA program agreement. The parent or guardian assumes full responsibility for the minor's use of ElyIT services and compliance with these Terms.

4. Accounts

To access course content or register for events, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate, current, and complete information during registration and to update such information as necessary. ElyIT reserves the right to terminate accounts that contain false or misleading information.

When you enroll in a course that includes access to learn.elyit.com, our Moodle-based learning platform, ElyIT will automatically create a Moodle account on your behalf using the name and email address from your ElyIT account. You are responsible for activity conducted through your Moodle account in accordance with these Terms.

5. Course Enrollment & Payment

Course prices are listed in U.S. dollars and are subject to change without notice. All payments are processed securely through Stripe. ElyIT does not store your payment card information.

A one-time, non-refundable Application Fee of $35.00 is charged on your first purchase with ElyIT. This fee covers the administrative costs of establishing your student account and enrollment record, and is collected in addition to course tuition. The Application Fee is not subject to refund under any circumstances, including cancellation or withdrawal.

Applicable sales tax is collected at checkout in accordance with Arizona Transaction Privilege Tax (TPT) law. Tax is calculated on tuition only and will be displayed as a separate line item before you complete your purchase.

Upon successful payment, you will receive access to the enrolled course through your student dashboard at elyit.com and, where applicable, through the learning platform at learn.elyit.com (powered by Moodle). Course access is granted to the individual purchaser only and may not be transferred or shared.

6. Refund Policy

ElyIT's refund policy is governed by our Refund Policy, which is incorporated into these Terms by reference. Please review it carefully before enrolling.

7. Course Content & Intellectual Property

All course materials, content, videos, written materials, practice questions, and other resources provided by ElyIT are the intellectual property of ElyIT and are protected by applicable copyright and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use course content solely for your personal educational purposes. You may not reproduce, distribute, modify, create derivative works from, or sell any course content without express written permission from ElyIT.

8. Third-Party Certification Marks & No Affiliation

CompTIA®, A+®, Network+®, Security+®, CySA+®, Linux+®, Tech+™, SecAI+™, and related marks are registered trademarks or trademarks of CompTIA, Inc. Cisco®, CCNA®, CCNP®, and related marks are registered trademarks or trademarks of Cisco Systems, Inc. All other certification marks referenced on this Site are the property of their respective owners.

ElyIT is an independent exam preparation provider and is not affiliated with, sponsored by, endorsed by, or authorized by CompTIA, Cisco, or any other certification body. ElyIT's use of these marks is solely for descriptive purposes to identify the certification examinations for which our preparation materials are designed.

9. Skills Assessment Disclaimer

ElyIT offers a free Skills Assessment tool that allows learners to benchmark their current knowledge across topic domains relevant to specific IT certifications. Results from the ElyIT Skills Assessment are for self-study reference only and are subject to the following limitations:

  • Skills Assessment scores are not indicative of performance on any actual third-party certification examination. A high score, including a perfect score, on the ElyIT Skills Assessment does not predict, guarantee, or suggest a passing result on any CompTIA, Cisco, or other vendor exam.
  • Assessment questions are developed by ElyIT as illustrative examples of the types of topics that may appear on a given certification exam. They are not actual exam questions, are not sourced from certification providers, and are not validated or endorsed by CompTIA, Cisco, or any other certification body.
  • Actual certification exam content, format, difficulty, and passing thresholds are determined solely by the issuing certification body and may differ substantially from the ElyIT Skills Assessment.
  • Skills Assessment results should be used only as a personal study guide to identify potential knowledge gaps. They are not a substitute for thorough preparation, professional instruction, or authorized practice resources from the certification provider.

ElyIT makes no representations or warranties regarding the accuracy, completeness, or predictive value of Skills Assessment results. Any reliance on Skills Assessment scores is at the learner's own risk.

10. Career Path Planner Disclaimer

ElyIT provides a Career Path Planner tool designed to help learners explore potential IT career trajectories, understand general skill requirements, and set realistic expectations for career transitions. The Career Path Planner is provided for informational and structural guidance purposes only.

  • ElyIT does not guarantee employment, job placement, salary outcomes, career advancement, or any other specific professional result from using the Career Path Planner or completing any ElyIT program.
  • Career paths, timelines, and salary ranges presented in the tool are generalizations based on publicly available industry data. Individual outcomes depend on factors entirely outside ElyIT's control, including but not limited to individual effort, prior experience, geographic location, labor market conditions, employer preferences, and broader economic factors.
  • The Career Path Planner does not constitute career counseling, professional career advice, or employment consulting. ElyIT is not a licensed career counseling service or employment placement agency.
  • Completing an ElyIT course or certification preparation program does not guarantee that a learner will qualify for, be offered, or successfully obtain any particular position or compensation level.

ElyIT encourages learners to use the Career Path Planner as a starting framework for their own research and independent planning. Every learner's journey is shaped by unique individual effort, circumstances, and opportunities that ElyIT cannot anticipate or control.

11. Acceptable Use

You agree not to use the Site or our services to:

  • Violate any applicable local, state, federal, or international law or regulation
  • Share your account credentials or course access with others
  • Reproduce or distribute course materials without authorization
  • Submit false or misleading information through any form on the Site
  • Attempt to gain unauthorized access to any part of the Site or its systems
  • Engage in any conduct that could damage, disable, or impair the Site or other users' experience
  • Post abusive, harassing, or inappropriate content in any forum, message, or discussion area on learn.elyit.com
  • Attempt to share, copy, or redistribute course content accessed through learn.elyit.com outside of your personal use

12. Disclaimers & No Warranty

The Site, all content, tools, and services are provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

ElyIT does not warrant that: (a) the Site will be uninterrupted, error-free, or free of viruses or other harmful components; (b) any information provided through the Site is accurate, complete, or current; or (c) any particular educational outcome, certification result, or career outcome will result from use of our services.

ElyIT does not provide legal, financial, or professional career advice. Nothing on the Site should be construed as such. Learners should consult qualified professionals for advice specific to their individual circumstances.

Certification exam objectives and formats are owned and controlled by third-party certification bodies and may change at any time. ElyIT makes reasonable efforts to align preparation materials with published exam objectives but cannot guarantee that content remains current following any exam objective revision by the respective certification body.

13. Limitation of Liability

To the fullest extent permitted by applicable law, ElyIT, its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Site or our services, even if ElyIT has been advised of the possibility of such damages.

This includes but is not limited to: loss of revenue or profits; failure to pass a certification examination; failure to obtain employment or a specific salary level; loss of data; loss of opportunity; or any other tangible or intangible losses.

ElyIT's total cumulative liability to you for any and all claims arising from these Terms or your use of our services shall not exceed the total amount you paid to ElyIT in the twelve (12) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability. In such jurisdictions, ElyIT's liability shall be limited to the greatest extent permitted by law.

14. Indemnification

You agree to defend, indemnify, and hold harmless ElyIT and its owners, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Site or our services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any content or information you submit through the Site.

15. Dispute Resolution & Class Action Waiver

Informal Resolution. Before initiating any formal dispute, you agree to contact ElyIT at info@elyit.com and provide a written description of the dispute. ElyIT will attempt to resolve the issue informally within thirty (30) days of receipt.

Binding Arbitration. If informal resolution fails, you agree that any dispute, claim, or controversy arising from or relating to these Terms or your use of ElyIT services shall be resolved by binding arbitration administered under the rules of the American Arbitration Association (AAA) in Maricopa County, Arizona, rather than in court, except as provided below. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Exceptions. Either party may seek relief in small claims court in Maricopa County, Arizona for disputes within that court's jurisdictional limits. Either party may also seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened intellectual property infringement or misappropriation.

Class Action Waiver. You and ElyIT agree that each may only bring claims against the other in your or its individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. If a court finds this class action waiver unenforceable as to any claim, that claim shall be severed and litigated in court while remaining claims proceed in arbitration.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. To the extent court proceedings are permitted under these Terms, you consent to the exclusive personal jurisdiction of the state and federal courts located in Maricopa County, Arizona.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions of these Terms shall continue in full force and effect.

18. Changes to These Terms

ElyIT reserves the right to update these Terms at any time. We will update the "Last updated" date when changes are made. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
