Affiliate Terms
The full terms of the ElyIT Affiliate Program. Read these before you apply — you'll be asked to accept them when your account is set up. Approved affiliates can also review them anytime from the affiliate dashboard.
ElyIT Affiliate Program — Terms & Conditions

These Affiliate Terms of Service ("Terms") govern your participation in the ElyIT Affiliate Program ("Program"). By accepting these Terms, you ("Affiliate") agree to be bound by the following conditions.
1. Program Enrollment & Eligibility
Participation in the Program is by invitation only, following approval of your application by ElyIT. ElyIT reserves the right to approve or deny any application at its sole discretion, with or without stated reason.
2. At-Will Removal
ElyIT may remove any Affiliate from the Program at any time, with or without cause or prior notice. Upon removal, your unique referral link and promo code will be deactivated immediately. If removal is not due to fraud or malicious activity, any commissions that have vested (i.e., the referred student's refund window has closed — see Section 4) but have not yet been paid will be disbursed on the next scheduled monthly payment cycle. If removal is due to fraud, malicious activity, or violation of these Terms, all pending and unpaid commissions are forfeited.
3. Commission Structure
Affiliates earn commission on tuition paid by referred students after the 5% affiliate discount is applied, excluding the $35 application fee and any applicable taxes. Commission rates are based on lifetime referral count:
- Referrals 1–25: 5% commission
- Referrals 26–50: 7% commission
- Referrals 51+: 10% commission
As an example: if a student enrolls in a $500 course using your promo code (5% off = $475 tuition), your 5% commission on the discounted tuition would be $23.75.
4. Commission Vesting
Commissions are not earned until a referred student passes the point of no refund, defined by ElyIT's published Refund Policy as 60 calendar days from the enrollment date. Commissions vest automatically the day after that window closes; no action is required from you. Commissions that have not yet been paid are subject to forfeiture if the student receives a full or partial refund.
5. Payment Schedule
Vested commissions are paid on the 1st of each calendar month for commissions that vested in the prior month. ElyIT reserves the right to hold payment if there is a reasonable basis to suspect fraudulent activity pending investigation.
6. Payouts & Payment Processing
Affiliate commissions are paid through Stripe, our third-party payment processor, via Stripe Connect. To receive payment, you must complete Stripe's onboarding, which includes identity verification and providing your bank or payout details directly to Stripe. ElyIT does not collect, view, or store your bank account or payout credentials; that information is held and secured by Stripe under Stripe's own terms and privacy policy. You are responsible for keeping your Stripe payout information accurate and current, and for any errors or delays caused by incorrect information you provide to Stripe. No commission is payable until your Stripe account is fully onboarded and payouts are enabled. Your use of Stripe is also governed by the Stripe Connected Account Agreement.
7. Prohibited Conduct
The following conduct will result in immediate removal from the Program and forfeiture of all commissions:
- Self-referral (using your own promo code or link to purchase courses for yourself or associates)
- Spamming, unsolicited messaging, or deceptive marketing
- Running paid advertisements targeting ElyIT's brand name or variations thereof
- Making false or misleading claims about ElyIT, its courses, or expected outcomes
- Cookie stuffing, click fraud, or any manipulation of referral attribution
- Misuse of ElyIT's logo, trademarks, or brand assets without prior written approval
- Directing promotion at minors. ElyIT's courses serve students in grades 8 to 12, and all promotion must be addressed to parents or legal guardians. You may not market to, message, or solicit a minor directly, and you may not use urgency or pressure tactics in any content aimed at students.
- Guaranteeing outcomes. You may not state or imply that ElyIT guarantees a passing exam score, certification, admission, employment, or any level of earnings.
- Misrepresenting credentials or credit. You may not state or imply that ElyIT is an accredited institution, that its courses carry school, college, or district credit, or that ElyIT teaches coding or computer programming.
- Advising on Arizona ESA eligibility. You may not advise families on Empowerment Scholarship Account eligibility or represent that any purchase, expense, or reimbursement will be approved by the Arizona Department of Education or ClassWallet. You may state that ElyIT is an approved vendor and that payment through ClassWallet is accepted.
- Sharing your commission with a referred family, or offering any other inducement. You may not rebate, refund, split, or otherwise pass any portion of your commission back to a referred student or family, and you may not offer cash, gift cards, prizes, or other consideration in exchange for using your link or promo code. The discount ElyIT applies at checkout is the only benefit a referred family may receive. This restriction applies regardless of payment method and is enforced strictly where a purchase is funded by an Empowerment Scholarship Account, because passing value back to the purchaser can convert program funds into a personal cash benefit.
8. FTC Disclosure Requirement
You are required by U.S. Federal Trade Commission guidelines to clearly disclose your affiliate relationship with ElyIT in any content where you promote ElyIT or use your affiliate link. This disclosure must be conspicuous and placed near the affiliate link or promotion. ElyIT is not liable for your failure to comply with FTC disclosure requirements.
9. Account Monitoring
ElyIT proactively monitors affiliate accounts for suspicious login activity, including but not limited to logins from multiple IP addresses in a short time window, anomalous device behavior, and patterns consistent with account compromise. By accepting these Terms, you consent to this monitoring. Flagged activity may result in account review or temporary suspension pending investigation.
10. Tax Responsibilities
You are solely responsible for reporting and paying all taxes owed on commissions received. You provide your tax information (such as a W-9) to Stripe during payout onboarding, and any required tax forms (e.g., 1099-NEC) may be issued by ElyIT or by Stripe on ElyIT's behalf in accordance with applicable law. You agree to provide accurate and complete tax information upon request.
11. Attribution
A referral is credited to you in one of two ways: the family enters your promo code at checkout, or they arrive through your referral link. Link tracking is performed on a best-effort basis using a 30-day browser storage window from the date of the click; ElyIT does not guarantee link attribution in all cases, including but not limited to users who clear browser storage, use incognito/private mode, or access from a different device. Entering your promo code always credits you, regardless of that window.
Once a student has been credited to you, that attribution is recorded permanently. Every additional course that student later enrolls in earns you commission at your then-current rate, whether or not a code or link is used again. Attribution is assigned to the first Affiliate credited for a given student and is not transferable; a promo code entered at checkout still determines the discount and the credit for that particular purchase. Attribution disputes will be reviewed at ElyIT's discretion.
12. Intellectual Property
You may use ElyIT-provided marketing materials and approved brand assets only. Unauthorized modification of ElyIT's name, logo, or trademarks is prohibited. ElyIT retains all intellectual property rights in its brand and content.
13. Approved Marketing Materials & Claims
ElyIT publishes an Affiliate Asset Kit containing approved promotional copy, disclosure templates, brand rules, and the list of claims you may and may not make. You are responsible for reviewing it before promoting ElyIT and for using current materials. Where your own wording differs from the Asset Kit, the restrictions in these Terms control. ElyIT may request the removal or correction of any affiliate content that is inaccurate, non-compliant, or off-brand, and you agree to comply promptly.
14. Non-Disparagement
You agree not to disparage ElyIT, its products, services, employees, or leadership on any platform, whether or not you are currently an active Affiliate.
15. Binding Arbitration & Class Action Waiver
To the fullest extent permitted by applicable law, you waive the right to participate in any class action lawsuit or class-wide arbitration against ElyIT related to the Program. Any dispute arising from these Terms shall be resolved on an individual basis through binding arbitration seated in Maricopa County, Arizona, under the laws of the State of Arizona. This does not prevent either party from seeking injunctive or other equitable relief in the courts of Maricopa County, Arizona.
16. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Exclusive jurisdiction and venue shall be in Maricopa County, Arizona.
17. Amendments
ElyIT reserves the right to modify, amend, or replace these Terms at any time, with or without prior notice to Affiliates, at its sole discretion. Any changes are effective immediately upon posting unless otherwise stated. Your continued participation in the Program after any change constitutes your acceptance of the revised Terms. It is your responsibility to review the current Terms periodically.
18. Entire Agreement
These Terms constitute the entire agreement between you and ElyIT with respect to the Program and supersede any prior understandings or agreements.
